ASUS "ZenFone 6" becomes "6Z": the legal dispute in India is resolved

By  Echo Ann 2019-06-10 620 0

It seems that the problem of the trade name of ASUS ZenFone 6 in India has been solved quickly: looking at the page dedicated to the new smartphone on the online retailer Flipkart (link in the VIA 2), in fact, you can see how the device is advertised as ASUS 6Z. AndroidPolice points out curiously that the URL still bears the words "zenfone 6" (but once online, there is little to correct ...), but what matters most is that the smartphone is now sold under the new name ending the lawsuit brought by Telecare Network.

ASUS may be forced to change the name of its ZenFone smartphones sold in India, because of a legal dispute initiated by Telecare Network, owner of two similar trademarks, "ZEN" and "ZENMOBILE".

According to the New Delhi High Court, Telecare Network registered and started using the trademarks "ZEN" and "ZENMOBILE" in 2008 while Asus arrived only a few years later, in 2014, with the first ZenFone models marketed in the populous Asian continent. The triggering factor that brought the Taiwanese manufacturer to court was aggravated by the fact that both companies are active in the trade of smartphones and mobile devices, moreover in a very similar price range.

Asus defended himself by stating that the ZenFone brand was inspired by the faith of its founder Jonney Shih in Zen philosophy, however, after a series of analyses by the New Delhi court, the first ruling was in favor of Telecare Network.

A new hearing will take place on July 10th and if Asus does not succeed in reversing the situation, starting from the 23rd of the same month, the latter will have to withdraw from sale in India any product and accessory that may contain the word Zen in its name.

This would inevitably lead to enormous damage to the image, but above all it would force Asus to change its name, so as not to interrupt sales on Indian territory, after the change of course taken by the company with ZenFone 6 and the excellent feedback from critics and the public for its latest top of the range.

ASUS commented on the recent legal case with the following statement:

The ASUS legal team is working with the Delhi High Court in India to resolve the case relating to the Zen and ZenFone trademarks. The supply of ASUS smartphones, laptops and other products, as well as the technical support and after-sales services of all ASUS products will remain unchanged for all consumers.
